Монгол Улсын Их Хурлын дарга Зандаахүүгийн Энхболдод Засгийн газрын гишүүн, Хууль зүйн сайд Д.Дорлигжав  өнөөдөр /2015.08.05/ Зөрчил шалган шийдвэрлэх тухай хуулийн төслийг өргөн барив.

 

 

Өнөөгийн байдлаар манай улсад зөрчлийг шалган шийдвэрлэх чиг үүргийг хэрэгжүүлэгч субьектууд болон тэдний эрх, үүрэг, хэрэгжүүлэх арга хэмжээг Захиргааны хариуцлагын тухай, Төрийн хяналт шалгалтын тухай хууль болон салбар тус бүрийн хуулиар зохицуулдаг. Эдгээр нь хуулийн давхардал, хийдэл, зөрчлийг үүсгэж, зөрчил шалган шийдвэрлэх ажиллагааг харилцан адилгүй хэрэгжүүлэх, хүний эрхийг журмаар хязгаарлах зэргээр хүн бүр хууль, шүүхийн өмнө эрх тэгш байх, аливаа хэлбэрээр ялгаварлан гадуурхагдахгүй байх Үндсэн хуулиар тунхагласан хүний эрхийг хангах явдал гажуудах шалтгаан болдог байна.



Дээрх асуудлыг зохицуулах зайлшгүй шаардлагыг харгалзан зөрчлийг шалган тогтоох ажиллагааны явцад хүний халдашгүй эрхийг хангах, зөрчил шалган шийдвэрлэх эрх бүхий албан тушаалтнуудын эрх хэмжээг нэг стандартад оруулж тодорхой хуульчлах зорилгоор Үндсэн хууль, Монгол Улсын нэгдэн орсон олон улсын хүний эрхийн гэрээний суурь зарчимд нийцүүлэн Зөрчил шалган шийдвэрлэх тухай хуулийн төслийг боловсруулсан болохыг Улсын Их Хурлын даргад танилцууллаа. Төслийг боловсруулахдаа Хууль зүйн яам, холбогдох байгууллага, судлаачдын сүүлийн 10 жилд хийсэн 20 орчим судалгаа, Монгол Улсын нэгдэн орсон олон улсын гэрээ, НҮБ-аас боловсруулсан процессын загвар хууль болон хэрэг хянан шийдвэрлэх ажиллагаанд хүний эрхийг хангах чиглэлээр Канад, Австрали, БНСУ, Япон улсын хууль, НҮБ-аас Монгол Улсын Засгийн газарт ирүүлсэн зөвлөмжийг ашигласан байна.

 

 

Уг хуулийн төсөл батлагдсанаар зөрчилд хариуцлага хүлээлгэх эрх бүхий албан тушаалтны үйл ажиллагаа нэгдсэн байдлаар журамлагдан иргэд, хуулийн этгээдийн эрх ашиг зөрчигдөх хүчин зүйл арилна. Мөн зөрчил шалган шийдвэрлэх ажиллагааны үндэслэл, журмыг хуулиар нарийвчлан зохицуулах нь эрх зүйт төр, хүмүүнлэг ардчилсан нийгмийг бэхжүүлэх үйлсэд томоохон хувь нэмэр оруулна хэмээн үзжээ гэж Улсын Их Хурлын Тамгын газрын Хэвлэл мэдээлэл, олон нийттэй харилцах хэлтсээс мэдээлэв.
