БНСУ-д оршин суудаг гадаадын иргэд энэхүү тогтолцооны талаар мэдээлэлгүйгээс гэмт хэргийн хохирогч болсон ч хууль бусаар амьдарч байгаа гэдгээсээ эмээн хууль хяналтын байгууллагын тусламжийг авч чадахгүй өнгөрдөг явдал нэлээд байдаг.
БНСУ-ын Эрүүгийн хуульд заасан хүн амь, танхай-хүчирхийлэл, барьцаалах, зодох, гэрийн хорионд байлгах, дарамтлах, бэлгийн хүчирхийлэл, хүчин, хулгай, дээрэм, залилан, биеийг нь үнэлүүлэх гэх мэт хэргийн хохирогч болсон тохиолдолд дээрх тогтолцоонд хамрагдах боломжтой. Харин хөдөлмөрийн хөлсөө авч чадаагүй зэрэг иргэний болон хөдөлмөрийн маргаан, гэмт хэргийн хохирогч боллоо хэмээн хуурамч мэдээлэл өгсөн этгээд, харилцан зодолдсон этгээд хамаарахгүй ажээ.
