Ерөнхий сайдыг огцруулах хуралдааныг даргалсан Х.Булгантуяа нь УИХ-ын чуулганы дэгийн тухай болон Үндсэн хууль илтэд зөрчсөн гэгдэж буй. Товчхондоо Үндсэн хуулийн 43-р зүйлийн нэгд Улсын Их Хурлын гишүүдийн дөрөвний нэгээс доошгүй нь Ерөнхий сайдыг огцруулах саналыг албан ёсоор тавибал Улсын Их Хурал гурав хоногийн дараа хэлэлцэж эхлэн арав хоногийн дотор шийдвэрлэнэ. Улсын Их Хурлын нийт гишүүний олонхи уг саналыг дэмжсэн бол Ерөнхий сайдыг огцруулах тухай Улсын Их Хурлын тогтоол баталсанд тооцож, шинэ Ерөнхий сайдыг гуч хоногийн дотор томилно гэж заажээ. Үндсэн хуулийн дээрх заалтад УГ САНАЛ-ыг гэдэг нь анх өргөн мэдүүлсэнээр нь Ерөнхий сайдыг огцруулах асуудлыг хэлэлцэх ёстой гэсэн санаа. Гэтэл УИХ ТББХ-ны саналын томьёоллоор буюу Ерөнхий сайдыг огцруулахыг дэмжээгүй саналыг дэмжих үү гэдгээр санал хураасан нь Үндсэн хуулийн зөрчил гэж үзээд буй. Мөн УИХ-ын гишүүд үндсэн хууль зөрчсөн гэж үзвэл уг хуралдаанд оролцохгүй байх эрхтэй ч Х.Булгантуяа үндсэн хууль зөрчсөн хуралдаанд гишүүдийг оролцохыг элдвээр шаардаж байсан зэрэг нь өнөөдөр түүний бүрэн эрхтэйгээ үлдэх үү гэдэг асуудлыг ч хөндөж эхлээд буй.
