2025 оны аравдугаар сарын 22-нд Үндсэн хуулийн цэцийн дүгнэлтээр Улсын Их Хурлын гишүүн Х.Булгантуяаг Үндсэн хууль зөрчсөн болохыг тогтоосон.

Цэцийн уг дүгнэлт “албан тушаалтны талаар гарсан Цэцийн дүгнэлт Улсын Их Хуралд хянагдахгүй, гагцхүү шийдвэр гаргах үндэслэл болно.

Өөрөөр хэлбэл, Улсын Их Хурлын гишүүн Х.Булгантуяа Үндсэн хууль зөрчсөн тухай Цэцийн дүгнэлтийг Улсын Их Хурал хүлээн зөвшөөрөх эсэх талаар хэлэлцэх нь өөрөө Үндсэн хуулийн зөрчилд орж болзошгүй.

Түүх сануулбал,

1991 онд Монголын улс төр, хууль хяналтын байгууллагыг доргиосон “Алт дилерийн хэрэг” гарч байв. Тухайн үед Ерөнхий сайд асан Д.Бямбасүрэн энэ хэрэгт холбогдон шалгагдаж, хяналтыг Улсын Ерөнхий Прокурорын газрын хяналтын прокурор Г.Баясгалан хийж байсан гэдэг. Хэргийг шалгах явцад тухайн үеийн Улсын Ерөнхий прокурор Н.Ганбаяр Үндсэн хууль зөрчсөн тухай асуудал үүсч, “иргэн” болсон Д.Бямбасүрэн Үндсэн хуулийн Цэцэд ханджээ. Цэцийн хуралдаанд “прокурорын ажилтан Г.Баясгалан” оролцсон тухай 1994 оны тэмдэглэлд тодорхой дурдсан байдаг. Удалгүй Үндсэн хуулийн Цэц Н.Ганбаяр нь Үндсэн хууль зөрчсөн гэсэн дүгнэлт гаргасан. Гэхдээ УИХ энэ дүгнэлтийг хэлэлцээд “хүлээн авахгүй” гэсэн тогтоол гаргаж байжээ. Үүний дараа иргэн Ламжав ҮХЦ-д дахин өргөдөл гаргаж, Цэцээс “УИХ нь Цэцийн дүгнэлтийг хүчингүй болгох эрхгүй, харин шийдвэрийг шууд хэрэгжүүлэх ёстой” гэж үзэн, 1995 онд түүхэн шийдвэр гаргаж байжээ.

Х.Булгантуяа нь төрийн эрх мэдлийг хэрэгжүүлэхдээ Үндсэн хууль зөрчсөн гэсэн дүгнэлтийг Цэц нэгэнт гаргачихсан. Цэцийн энэ дүгнэлт эцсийн шийдвэр. Гэтэл УИХ-ын гишүүн  Б.Баярбаатар цэцийн шийдвэр эцсийнх биш мэтээр, УИХ цэцийн шийдвэрийг хэлэлцэж хүлээн зөвшөөрөх эсэхийг шийдэх мэтээр ойлгож,ойлгуулж яваа нь хол эндүүрэл юм. Хэрвээ түүний хэлсэнчлэн дүгнэлтийг УИХ хэлэлцэх юм бол энэ нь мөн л дахин Үндсэн хуулийн зөрчил болно. Тиймээс өргөсөн тангаргаасаа няцсан Х.Булгантуяаг  эгүүлэн татах асуудлыг хөндөх нь зүй ёсны болж таарч байна. Нээрэн тухайн өдөр Х.Булгантуяаг “чулганы танхимд заавал суух ёстой” гэсэн шахалтад хэн оруулсан байж болох уу? Улстөрийн хүрээнд ийм “шахалт” ихэвчлэн намын төв штаб, фракцын удирдлагаас ирдэг гэдгийг хэн ч мэднэ. Д.Амарбаясгалан, Г.Занданшатар нарын улстөрийн зодооны хөлд Х.Булгантуяа өртөж, энэ эмэгтэйгээр ‘’туг тахисан’’ нь үнэн.
