БОАЖ-ын сайд Б.Бат-Эрдэнэ Улаанбаатар хот, Богд хан уул өнөөдөр ямар хэмжээтэй барилгажсан байна, үүнээс ямар том том асуудлууд үүсэж байна, Зам харилцаа, дэд бүтэц, зайсанд амьдарч байгаа иргэдийн ууж байгаа уснаас ялгарч байгаа нян, ялгадасны асуудлаас болоод олон асуудал үүсэж байна.
Нөгөө талдаа суурьшлын бүс үүссэнтэй холбогдуулаад сургууль, цэцэрлэгийн асуудлууд хөндөгдөж байна.
Тийм учраас бид нэр мөр эдгээр асуудлыг шийдвэрлэх шаардлагатай ба тусгай хамгаалалтын газар нутгийн тухай хуульд өнгөрсөн хоёр жилийн хугацаанд өөрчлөлт, шинэчилсэн найруулга хийгдэхээр бүх бэлтгэл ажлыг хангаж ирсэн. УИХ-аар хараахан орж амжаагүй байна.
Анх 1995 оны 26 дугаар тогтоол гэж УИХ-аас баталсан тогтоол байдаг. Үүнд, Тусгай хамгаалалттай газар нутгуудын хил заагийг УИХ-аас тогтоож өгсөн бөгөөд тусгай хамгаалалттай газар нутаг буюу Дархан цаазат Богд хаан ууланд яагаад барилгажих процесс үүсэв?
Нэгдүгээрт, 2001 онд тусгай хамгаалалттай газар нутаг буюу Богд хан ууланд төр газар олгох журмыг олгосон байдаг. Ингэснээр Богдхан ууланд эхний барилгажих процесс эхэлсэн. АТГ-аас Мөрдөн шалгах үйл ажиллагааны хүрээнд олон удаа үүссэн нөхцөл байдалтай холбогдуулаад үе үеийн байгаль орчны сайд нарт түр зөвшөөрлийг цуцлахыг даалгасан мөрдөгчийн мэдэгдлүүдийг ирүүлсэн байдаг.
Энэ асуудал өнгөрсөн хугацаанд огт шийдэгдээгүй. 2022 оны нэгдүгээр сард би томилогдсон. Энэ АТГ-аас мөрдөгчийн мэдэгдэл бол мөн тухайн үед ирсэн. Бид мэдэгдлийг нэн даруй хүлээн авч тухайн 2001 оны газар олгох түр журмыг албан ёсоор цуцалсан.
Хоёрдугаарт, 2011 онд тухайн үед газарзүйн зураг, геодиз зурагзүйн газраас улбаатай тухайн үеийн байгаль орчны сайдтай холбоотой 1995 оны 26 дугаар тогтоолыг зөрчсөн үйлдэл гаргасан. Энэ бол нийслэлийн мэдэлд байсан газрыг Богд Хан уулын хамгаалалтын бүс рүү нэмэж оруулсан. Үүн дээр байгаль орчны үе үеийн газар олголтын асуудлууд хөндөгддөг. Энийг байгаль орчны яамнаас хууль хяналтын байгууллагад тодорхой мэдээллүүдийг гаргаж өгч одоо бол хууль хяналтын байгууллага дээр шалгагдаад явж байгаа гэсэн мэдээлэлтэй байгаа. Энэ бол хоёр дахь удаагийн БОАЖЯ, Нийслэл, БХБЯ-тай холбоо бүхий газар олголттой асуудлууд үүссэн.
Гуравдугаарт, 2013 он Улаанбаатар хот буюу ялангуяа Нисэх, Яармагийг хөгжүүлэх ерөнхий төлөвлөгөө гэдгийг НЗДТГ, ИТХ дээр батлаад 2014 онд дэд бүтэц татах зөвшөөрлийг албан ёсоор гаргаад 2015 онд Богд хан уул буюу дархан цаазат газарт өндөршилтэй барилгажилт буюу хоёр давхраас дээш барилга барихыг хориглосон байсан” гэсэн заалтыг 2015 онд стандарт дотроос нь авч хаясан байгаа юм. Ингэснээр Богд хан уул өндөр байшин барилга баригдах нөхцөл байдал үүссэн байдаг юм.
