УИХ-ын гишүүн Даваагийн Цогтбаатар нь Хөгжлийн банкны захирлаар ажиллаж байх үедээ албан тушаалын байдлаа урвуулан ашиглаж Мондулаан, Газ Импорт, Бэрэн групп-д давуу байдал олгож Эрүүгийн хуулийн 22.1-т заасан гэмт хэрэг үйлдсэн нь тогтоогдсон байдаг. Шүүхийн шийдвэр гарч УИХ-ын гишүүнээс эргүүлэн татагдах хуулийн шаардлага үүссэн ч “шинэ парламент” түүний бүрэн эрхийг түтгэлзүүлэлгүй дээд шүүхийн “тогтоол албажаагүй” шалтгаанаар хамгаалж үлдсэн. Харин энэ сарын 21-.нд дээд шүүхийн тогтоол албажиж Даваагийн Цогтбаатарын УИХ-ын гишүүний бүрэн эрх хугацаанаасаа өмнө дуусгавар болох үндэслэл хангагдаж байгаа юм.

Шаварт унасан шарын эзэн уг нь Хөгжлийн банкны асуудлаар давж заалдах шатны шүүхээс хэргийг нь хэрэгсэхгүй болгосны дараа УИХ-ын сонгуульд нэр дэвшжээ. Ингээд сонгогдсоных нь дараа дээд шүүхээс 20 саяын торгуулийн ял, 2 жил төрд ажиллахгүй байх ял оноожээ. Тухайн үед Хөгжлийн банкнаас зээл олгох шийдвэр гаргаж гарын үсэг зурсан дэд захирлууд нь цагаадаж, Д.Цогтбаатар нь зээлийн нөхцөл өөрчилсөн гэх үндэслэлээр яллагдсан байна. Ингээд нэгэнт дээд шүүхээс гэм буруутай нь тогтоогдож яллагдсан бол шүүхийн өмнө хүн бүр тэгш байх ёстой.

Дээд шүүхийн шийдвэр эцсийн шийдвэр бөгөөд бүх иргэн, байгууллага заавал биелүүлнэ” гэх Үндсэн хуулийн заалт бий.

Парламентад суусан хагас жил гаруйн хугацаанд 2025 оны төсвийн урсгал зардлыг 3.6 их наядаар бууруулах шаадрлагыг Л.Оюун-Эрдэнэд хүргүүлсэн нэр бүхий гишүүдийн нэг Даваагийн Цогтбаатар ийнхүү “сул зайг” гаргаад буцах болов.
