Үндсэн хуулийг өөрчлөхгүйгээр Ерөнхийлөгчийн дахин нэр дэвших эрх хаагдлаа

2019 оны Үндсэн хуулийн нэмэлт, өөрчлөлтөөр тухайн үеийн Ерөнхийлөгч Х.Баттулга дахин нэр дэвших эрхгүй болсон бол өнөөгийн Ерөнхийлөгч У.Хүрэлсүх ч мөн дахин нэр дэвших боломжгүй нөхцөл байдал үүсээд байна. Учир нь Үндсэн хуулийн 30.2-т зааснаар Монгол Улсын Ерөнхийлөгчийг “зургаан жилийн хугацаагаар зөвхөн нэг удаа сонгоно” хэмээн тодорхой заасан байдаг.

Гэвч энэ заалтад өөрчлөлт оруулах тухай улс төрийн хүрээнд яриа хөөрөө, хуйвалдаан өнгөрсөн хугацаанд удаа дараа сөхөгдөж байв. Тодруулбал, 2023 оны 4 дүгээр сард иргэн С.Номынбаясгалан, 2024 оны 1 дүгээр сард иргэн Э.Хишигсүрэн нар Үндсэн хуулийн цэцэд “Ерөнхийлөгчийг зөвхөн нэг удаа сонгоно” гэсэн заалтыг өөрчлүүлэх агуулгатай ижил төстэй гомдлууд гаргасан нь анхаарал татсан.

Эдгээр оролдлогуудын гол зорилго нь Ерөнхийлөгч У.Хүрэлсүхийг 2027 оны дараах Ерөнхийлөгчийн сонгуульд дахин нэр дэвшүүлэх үндэслэл бий болгох байсан талаар зарим эх сурвалжууд мэдээлж байв.

Үндсэн хуульд дахин өөрчлөлт оруулахгүй байх санаачилга...

Харин УИХ-ын гишүүн Х.Тэмүүжин “Үндсэн хуулийг тогтвортой байлгах” нэрийн дор Үндсэн хуульд дахин өөрчлөлт оруулахыг хориглох санаачилга гаргаж, энэ долоо хоногийн эхээр Ардчилсан намын бүлгийн хурлаар танилцуулсан байна.

2025 оны 5 дугаар сарын 5-ны өдөр болсон тус хурлын үеэр Ардчилсан намын бүлгийн 42 гишүүний 36 нь уг саналыг дэмжиж, гарын үсгээ зурсан нь Үндсэн хуулийн цаашдын өөрчлөлтийг улс төрийн хүрээнд хаасан томоохон алхам боллоо.

Хачирхалтай нь, анх энэ санаачилгад гарын үсэг зураагүй үлдсэн зургаан гишүүний дунд Х.Баттулга байсан бөгөөд түүнийг дахин нэр дэвших сонирхолтой хэмээн харж байв. Гэсэн ч тэрбээр 2025 оны 5 дугаар сарын 13-ны өдөр буюу өчигдөр уг саналд гарын үсэг зурсан нь улс төрийн орчинд том дохио өгч байна. Энэ нь түүний зүгээс “Ерөнхийлөгчийн сонгуульд дахин нэр дэвшихгүй” гэсэн байр сууриа албан бусаар илэрхийлсэн үйлдэл хэмээн ойлгогдож байна.

Үндсэн хуульд өөрчлөлт оруулах боломж хумигдлаа

Монгол Улсын Үндсэн хуульд нэмэлт, өөрчлөлт оруулахын тулд УИХ-ын нийт гишүүдийн дөрөвний гурав буюу 95 гишүүний санал шаардлагатай. АН-ын бүлгийн гишүүдийн олонх “Үндсэн хуулийг дахин өөрчлөхгүй” гэсэн байр суурин дээр нэгдсэнээр энэ парламентын бүрэн эрхийн хугацаа буюу 2024–2028 онд Үндсэн хуульд дахин өөрчлөлт орох боломж үндсэндээ үгүй болсон юм.

Цаашлаад иргэдийн гаргасан гомдлын хүрээнд Үндсэн хуулийн Цэцийн тухай хуулийн 8.2.1-д заасан, “...Үндсэн хуульд нийцэж байгаа эсэх”-ийг хянах эрхийн хүрээнд 2019 оны нэмэлт, өөрчлөлтөд хүрэх оролдлого гарч болзошгүй байсан ч дээрх улс төрийн тохиролцоогоор энэхүү боломж ч хаагдаж байна.

Үндсэн хуулийг дахин өөрчлөхгүй байх улс төрийн шинэ зөвшилцөл нь Ерөнхийлөгчийн бүрэн эрхийн хязгаарыг хадгалж, дахин нэр дэвших маргааныг төгсгөл болгож байна. Энэхүү алхам нь Монгол Улсын Үндсэн хуулийн тогтвортой байдал, институцийн хяналт-тэнцлийг хадгалах чухал алхам боллоо гэж үзэх үндэстэй.
