Монголын эдийн засгийн тулгуур багануудын нэг болох Эрдэнэт үйлдвэр-ийн 49 хувийн асуудал олон жилийн турш улс төр, хууль эрх зүй, бизнесийн орчны маргааны төвд байсаар байна. Энэхүү кейс нь зөвхөн нэг компанийн хувьцааны тухай биш, харин Монгол Улсад хувийн өмч хэр хамгаалагдаж байгаа вэ гэдгийг тодорхойлох томоохон сорилт болжээ.

Өчигдөр УИХ-ын Байнгын хорооны хуралдаан дээр болсон процесс энэ кейсийг дахин сануулж байна Худалдан авалт ба төрийн оролцоо 2016 онд тус үйлдвэрийн 49 хувийг Монголын хувийн хэвшлийн компаниуд ОХУ-ын талаас ойролцоогоор 400 сая ам.доллараар худалдан авсан. Энэ нь стратегийн томоохон ордод дотоодын хөрөнгө оруулалт орж ирсэн анхны тохиолдлуудын нэг болсон юм. Гэвч 2017 онд Монгол Улсын Засгийн газар уг хэлцлийг хууль зөрчсөн гэж үзэн 49 хувийг төрд шилжүүлэх шийдвэр гаргасан.

Үүнээс хойш уг асуудал шүүх, прокурор, улс төрийн түвшинд үргэлжилсэн маргаан дагуулсаар байна. Эдийн засгийн ач холбогдол Эрдэнэт үйлдвэр нь жил бүр улсын төсөвт 1–2 их наяд төгрөгийн орлого төвлөрүүлдэг гэж үздэг. Иймд өмчлөлийн асуудал нь зөвхөн хувь эзэмшигчдийн асуудал биш, харин улсын эдийн засгийн бодлого, тогтвортой байдалтай шууд холбоотой юм.

Маргааны гол цөм: Хууль дээдлэх зарчим Шүүмжлэгчдийн үзэж буйгаар, хэрэв тухайн хэлцэлд хууль зөрчсөн асуудал байсан бол түүнийг шүүхийн ил тод процессоор шийдвэрлэх ёстой байсан. Харин төр шууд оролцож өмчийг “буцаан авах” шийдвэр гаргасан нь хууль дээдлэх зарчимд эргэлзээ үүсгэсэн гэж үздэг.
